1. Intellectual Property & Ownership

• Copyright: All digital products offered by Meghan Delnea Design Studio are protected by copyright law and remain the exclusive intellectual property of Meghan Delnea Design Studio. This includes all designs, patterns, text, graphics, and any other content within the digital files.

• No Transfer of Ownership: Your purchase grants you a license to use the digital product, not a transfer of ownership of the intellectual property.

2. License Grant & Permitted Use

Personal Use License ONLY

• Personal, Non-Commercial Use: You are granted a limited, non-exclusive, non-transferable license to use the purchased digital product solely for your personal, non-commercial purposes.

• Examples of Permitted Personal Use:

• Printing for your personal use (e.g., in your home, for personal craft projects).

• Using as a digital background for personal devices.

• Incorporating into personal, non-profit, non-monetized projects (e.g., personal blog post not promoting a business, personal social media without commercial intent).

• Strictly Prohibited: You may NOT use the digital product for any commercial purpose, redistribute, resell, sublicense, modify, or create derivative works for sale or profit.

3. Restrictions on Use (Applies to ALL licenses)

• You may NOT share, transfer, or distribute the digital files to any third party (unless explicitly part of a commercial license, e.g., to a printer for production of a specific end product).

• You may NOT modify, alter, or create derivative works for distribution or resale without explicit written permission from Meghan Delnea Design Studio, beyond the scope of the purchased license.

• You may NOT use the digital products in any way that is unlawful, harmful, defamatory, or infringes upon the rights of others.

• You may NOT circumvent any digital rights management (DRM) or security measures.

4. Refunds & Returns

• Due to the digital nature of the products, all sales are final. No refunds or exchanges will be given once the digital product has been downloaded.

• Please ensure you have the appropriate software to open and use the files before purchasing.

5. Disclaimer of Warranties

• The digital products are provided "as is," without any warranties, express or implied. Meghan Delnea Design Studio does not warrant that the digital products will meet your specific requirements or that their operation will be error-free.

• You assume all responsibility for the use of the digital products.

6. Limitation of Liability

• Meghan Delnea Design Studio shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses, resulting from the use or inability to use the digital product.

• These Terms of Use shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
